50% Tax Rebate for Australian Small Businesses
Purchasing New Art before 31 December 2009.
The Australian Tax Office have confirmed that small businesses (i.e. If you own a registered business, with a turnover of less than $2 million per annum) are now eligible for an investment allowance of up to 50% of the purchase cost of artworks. This is great news for small businesses wishing to invest in artworks for their reception/meeting areas and to create a fantastic impact on their work premises. It is also great news for galleries and artists across the nation.
To qualify for the allowance, certain eligibility guidelines must be met. The most important are:
• The purchaser must have an ABN and have turnover less than $2 million per annum;
• The business must demonstrate a dominant business-related purpose for the display of the artworks - for example, we understand that visual display of the artworks on business premises on offices and meeting rooms is acceptable;
• Artworks must be purchased for $1,000 or more, to qualify;
• Artworks must be in a tangible form and portable i.e. capable of being moved from one place to another;
• Artworks must be the work of a living artist with a registered ABN and not owned by any other party but the artist prior to purchase;
• Artworks must be recently created and purchased directly from the artist or their respective agent or commercial gallery;
• Artworks must not be purchased as trading stock (i.e. art dealers and galleries do not qualify for the investment allowance);
• To qualify artworks must be purchased by December 31, 2009.
Before you purchase a piece it is recommend that you contact your accountant or the Australian Tax Office to make sure you are eligible for this small business incentive. Even if you are eligible as a business, the artwork you wish to purchase must also meet the criteria outlined above. It is your responsibility to ensure both you as a business, and your specific artwork purchase meet the required criteria upon purchase.
